Healthcare Reform Update

The Department Of Labor ("DOL") has released EXCHANGE MODEL NOTICES and GUIDELINES.


As required by the DOL, all employers subject to the FLSA (Fair Labor Standards Act) must comply with the Exchange Notice requirement under the Affordable Care Act. There is no exemption for small groups.


Eligible employer groups will need to distribute the Exchange Notice by October 1, 2013 to all part time and full time W-2 employees. 1099 and temporary workers are excluded from the notice.


After the initial distribution of the Exchange Notice to all W-2 employees, this document should then become part of an employer's "on boarding" process with new hires.
